Workers' Compensation

If you are injured at work, or in the scope of your employment, including aggravating a pre-existing condition or contracting a disease as a result of your employment, you are entitled to Workers’ Compensation Benefits under Pennsylvania law. Your employer is responsible for all medical, hospital, pharmacy, chiropractic, and therapy costs, whether you missed time from work or not. There are no co-pays, deductibles, or out-of-pocket expenses for medical bills associated with your Workers’ Compensation claim. If you lost a body part (finger, thumb, or hand), or the use of an eye, suffered a hearing loss, or have a facial or neck scar, your employer may be liable for a specific loss benefit in addition to your weekly indemnity benefits.

Attorney Frank Grzywinski has represented more than 500 Workers’ Compensation clients. Early in his Workers’ Compensation career, Mr. Grzywinski represented both employers and employees. This experience provided him with valuable insight into the defenses used in these cases and how they are valued by insurance companies. He has assisted injured workers in completing accident reports and filing claim and penalty petitions against employers and insurance companies that violate the Workers’ Compensation Act and Regulations. He has defended his clients against termination, suspension, and modification of their Workers’ Compensation benefits. Attorney Grzywinski has litigated cases before Workers’ Compensation Judges and argued cases before the Workers’ Compensation Appeal Board and the Appellate Courts of Pennsylvania. He has established legal precedents on the issues of offsets for future medical benefits and medical bills. He has represented clients with every type of physical injury and resulting mental health issues. Attorney Grzywinski has also represented the parents, spouses, and children of deceased workers in filing death claims under the Workers’ Compensation Act.

Even if you have returned to work and are no longer receiving weekly indemnity benefits, your employer and the Workers’ Compensation insurance company may be responsible for your ongoing medical, chiropractic, hospital, and pharmacy bills. You have the right to the medical treatment that you need to recover from your injury or illness.

An insurance company may offer you a lump sum settlement to settle your Workers’ Compensation case. You must review any offer with an attorney. Is the settlement offer fair? Who will pay your future medical and pharmacy bills? Will a lump sum settlement affect your future Social Security benefits?

Attorney Grzywinski has specialized in the complex issues and interaction between Workers’ Compensation, Social Security, and Personal Injury cases. Each of these cases may have an adverse effect on one of your other cases. He also has the experience to manage the complicated relationship between federal and state statues often involved in these cases.
